2. Pre-Requisites

It is advisable to have passed the subjects of Introduction to Criminal Law, Criminal Procedure, Advanced Criminal Law, and Victimology.

3. Justification in the curriculum, relation to other subjects and to the profession

The trend in recent years to apply alternative conflict resolution systems in the penal system has begun to be implemented progressively, not only based on the idea of mitigating criminal penalties, but also by looking at the victim as the protagonist of the process. Restorative Justice was born as an alternative model of Justice whose objective is to repair the damage caused by criminal conduct, proposing that the parties can reach a solution based on the seriousness of the crime. Although Restorative Justice does not replace Retributive Justice, it advocates recognizing the victim, gives him/her back the prominence he/she deserves and expands the functions assigned to the criminal system by repairing the damage in all its forms (patrimonial, symbolic, or emotional). That is why we talk of a more humanizing justice, which incorporates dialogue into the operation of the penal system to temper the violent consequences of the crime on the victim, as well as those inflicted by the institutional intervention on the offender. The most widespread practice of Restorative Justice is criminal mediation.

5. Objectives or Learning Outcomes

Description
To identify the different alternative criminal conflict resolution programmes and their peculiarities according to the phase of the procedure in which they are developed.
Be able to develop a hypothesis or suggestions based on evidence to support the criminal investigation.

- To know and analyze Restorative Justice as a way to approach the criminal act, taking into account the needs of the victims and the offenders. - To know and analyze the methodology of criminal mediation and other alternative systems for conflict resolution. - To acquire the fundamental concepts of Mediation from the criminal and criminological field. - To train students in criminal mediation strategies and methodology. - Training in criminal mediation skills.

8. Evaluation criteria and Grading System

Practical exam 30.00% 30.00% During the course, a series of practical cases will be carried out that will allow the student to demonstrate the acquisition of the knowledge, skills, and abilities of the subject. However, the practical content block will be evaluated in the final exam.

According to art. 4 of the UCLM Student Evaluation Regulations, it must be provided to students who cannot regularly attend face-to-face training activities the passing of the subject, having the right (art. 12.2) to be globally graded, in 2 annual calls per subject , an ordinary and an extraordinary one (evaluating 100% of the competences).

Evaluation criteria for the final exam:
  • Continuous assessment:
    The final exam will be composed of two blocks: a theoretical block made up of 20-question true/false test that will compute 60% of the final grade and a practical block made up of questions related to the practices that throughout the course and that will compute 30% of the final grade.
    To pass the subject, the student must pass both blocks independently; in such a way that only when the theoretical part has been passed will the practical part be added, and it must also be passed.
    The final grade will correspond to the sum of the scores of the different tests weighted by their global value (% of the global grade). To pass the subject, the final grade must be equal to or greater than 5.
  • Non-continuous evaluation:
    In the non-continuous evaluation, the theoretical block will compute 70% of the final grade and the practical block 30% of the final grade.
    To pass the subject, the student must pass both blocks independently; in such a way that only when the theoretical part has been passed will the practical part be added, and it must also be passed.
    The final grade will correspond to the sum of the scores of the different tests weighted by their global value (% of the global grade). To pass the subject, the final grade must be equal to or greater than 5.
