3. Justification in the curriculum, relation to other subjects and to the profession

The subject "Ethical and Legal Aspects of Nursing" is included in the Basic Training of the Nursing Degree. It is related to all the subjects of the "Nursing Sciences" block and those of the "Clinical Practice" block, as any caregiving activity must take into account the ethical-legal conditions linked to responsible, quality professional practice that respects the rights of patients and their families.


The aim of this course for the student is to acquire knowledge about the legislation that regulates and/or affects professional practice, as well as the ethical aspects derived from professional practice. The scientific-technological advances of the last decades have had a great repercussion in the health professions, which constantly face ethical-legal problems that test the capacity to understand, analyze, argue and face conflicts.

Its development includes general concepts on Ethics, values related to civic ethics, human rights and the ethics of care. The Deontological Code of Spanish Nursing and its practical implications are analysed, as well as the origins of Bioethics and its principles for tackling bioethical dilemmas. All this, considering the legal system and with the aim of providing care committed to the health and welfare of patients, taking into account the context and cultural peculiarities of each person.

5. Objectives or Learning Outcomes
Course learning outcomes
Description
Know the intercultural differences related to vital processes to apply them in the process of problem-solving and decision-making, based on respect for human rights, values and beliefs.
Know and apply the basic principles of current regulations concerning patient autonomy, and the legal obligations regarding clinical information and documentation.
Know and respect the applicable legislation and the Spanish Ethical and Deontological Nursing Code, inspired by the European Code of Ethics and Deontology, recognizing and knowing how to respond to dilemmas and ethical or moral issues.
Demonstrate knowledge of the ethical-legal aspects related to gender-based violence and other risk groups that allow the student to prevent, detect early, assist and rehabilitate victims.
Be aware of the different roles, responsibilities, and tasks of a nurse.
Work and communicate effectively with all team members, assuming mutual responsibility.
Use of professional language that encourages communication in the collaborative work group both in oral and/or written form.
Reflect on ethical dilemmas demonstrating knowledge of bioethical principles and the ability to apply them in problem-solving and decision-making.
Apply concepts related to the ethics of care guaranteeing the right to dignity, privacy, confidentiality and decision-making capacity of the patient and his/her family.
Take responsibility of his/her own learning and professional development.

The test will consist of a multiple-choice test in which cases and/or short questions may be included to be resolved. It will be necessary to obtain 5 points out of 10 in the exam globally in order to apply the criteria of continuous evaluation.

According to art. 4 of the UCLM Student Evaluation Regulations, it must be provided to students who cannot regularly attend face-to-face training activities the passing of the subject, having the right (art. 12.2) to be globally graded, in 2 annual calls per subject , an ordinary and an extraordinary one (evaluating 100% of the competences).

Evaluation criteria for the final exam:
  • Continuous assessment:
    The final test of the contents of the course must be passed with 5 points out of 10 globally in order to apply the criteria of continuous evaluation. The activities established in the cases studies section are considered passed if they have an average score of 5. If this criterion is not met, the student will have to retake those failing grade activities.
  • Non-continuous evaluation:
    Evaluation criteria not defined

Specifications for the resit/retake exam:
The final test of the contents of the course must be passed with 5 points out of 10 globally in order to apply the criteria of continuous evaluation. The activities established in the cases studies section are considered passed if they have an average score of 5. If this criterion is not met, the student will have to retake those failing grade activities.
Specifications for the second resit / retake exam:
Students will retake those recoverable activities and theoretical tests not passed during the course. The exam will be similar to the one proposed in the ordinary and extraordinary summons.
