2. Pre-Requisites

This is a basic subject and, therefore, does not require any prior knowledge other than that acquired in the corresponding branch of the baccalaureate. However, knowledge of the Theory of Law and Constitutional Law, as well as the prior acquisition of skills in public speaking and teamwork management, will be positively valued.  

3. Justification in the curriculum, relation to other subjects and to the profession

The subject Criminal Law I introduces the student to the fundamentals of criminal law, which are strongly linked to the country's political constitution. Perhaps this is why it has been said that the Criminal Code is the "Constitution in negative". Of the jurisdictional orders of the State, criminal law is the one that is subject to the greatest guarantees due to the fact that it inflicts the most serious sanctions.
For this reason, its position in the Law Syllabus is justified as a basic subject, because it serves to familiarise the student with basic legal concepts, such as the justification of punishment, the structure of the norm, the normative hierarchy, etc. In this sense, its strongest relationship is observed with Constitutional Law, Administrative Law and Procedural Law.
As far as the relationship of the subject with the profession is concerned, it should be pointed out that these are in fact "professions", some of which, such as those of judge, public prosecutor, state lawyer, etc., require a precise knowledge of criminal law. On the other hand, the profession of lawyer cannot be understood without criminal law; it is in criminal trials that there is a greater articulation between the evidential material and the prosecution or defence strategy for the substantiation of the relevance of the facts judged. Nowadays, moreover, the expansion of criminal law into everything related to economic matters gives this sector of the legal system a new dimension, which strongly links the criminal lawyer to consumer protection, in everything related to public health, banking law, etc.

ADDITIONAL COMMENTS, REMARKS

Topic 1 deals with the basic legal concepts, essential for subsequent knowledge of Criminal Law: legal norm, legal system and criminal legal system, hierarchy of norms, etc. 

Topic 2 includes the principles constructed by Spanish and European constitutional jurisprudence as the foundations of the penal system: legality, harmfulness, culpability, proportionality, resocialisation. 

Topic 3 serves to familiarise the student with the system of legal consequences of crime (penalties, security measures, civil liability), their scope and function. 

Topic 4 aims at the systematic analysis of the offence, its different elements and the content of the offence.

According to art. 4 of the UCLM Student Evaluation Regulations, it must be provided to students who cannot regularly attend face-to-face training activities the passing of the subject, having the right (art. 12.2) to be globally graded, in 2 annual calls per subject , an ordinary and an extraordinary one (evaluating 100% of the competences).

Evaluation criteria for the final exam:
  • Continuous assessment:
    Those students who follow the continuous assessment system must obtain a minimum mark of 5 out of 10 in the sum of the progress tests carried out as well as the assessment of participation in class.
    Clarity in the exposition of concepts
    Analytical acuity
    Understanding of interrelated problems.
  • Non-continuous evaluation:
    Those students who do not follow the continuous assessment system or do not pass it, must pass a final test with a mark of 5 out of 10, by means of a practical test in which they must fully resolve a criminal case, with the argumentation required by the doctrine of the Supreme Court to give validity to criminal decisions.
