The subject provides a general and introductory knowledge for the understanding of Law. Its object is not just the analysis of the content of the legal norms of a specific community or of the constructions that each particular dogmatic elaborates on them. Its purpose is to offer a general vision of Law in a broad and polyhedral sense. The topics include both a description of the structure of Law in general and of our legal system in particular, as an approach to the connection of Law with other elements of societies and with morality. The final objective is to provide the student the opportunity to approach, with a conceptual basis and critical view, to the Law as a regulatory system of social relations.

  • Unit 1: Law as a social phenomenon. Law concept and functions. Law and economics.
  • Unit 2: The system of sources. Jurisprudence and doctrine. Map of the positive Law. Division of powers and Rule of Law.
  • Unit 3: Law as a system: unity, coherence and plenitude. The legal norms: justice, effectiveness and validity.
  • Unit 4: Legal interpretation: theories and interpretive problems. The legal argumentation.
  • Unit 5: The application of the Law: the justification of judicial decisions. Factual and normative premises. The legal qualification.
  • Unit 6: Justice and law: the relationship between law and morality
